Terms of sale
These terms are not finished, and nothing on this site is for sale, so there is nothing for them to govern yet. The headings are the ones a consumer sale of used hardware in the UK has to cover. Each names what belongs in it rather than pretending to be binding text. Real terms will be published, and reviewed, before a single machine can be ordered.
Who you would be buying from
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. Trading name, registered company name and number, registered address, VAT position and contact details.
Orders and when a contract is formed
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. States that a listing is an invitation to treat, when we accept an order, our right to decline one, and what happens when a specific used machine has already been sold.
Prices and payment
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. Currency, whether VAT is included, when payment is taken, accepted methods, and what happens if a price is displayed incorrectly.
Delivery
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. Where we ship to, carriers, indicative timescales, cost, when risk passes to you, and what to do about a damaged or missing parcel.
Cancellation and returns
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. The distance-selling cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013: the 14-day window, how to cancel, who pays return postage, the condition the machine must come back in, and how long a refund takes.
Your legal rights
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. Confirms your rights under the Consumer Rights Act 2015 — goods as described, fit for purpose and of satisfactory quality, with satisfactory quality read against the age and condition of used equipment — and states that nothing in these terms reduces them.
Condition of used hardware
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. Describes how we grade cosmetic condition, what is tested before dispatch, which parts are replaced as a matter of course, and what a battery figure on a used machine does and does not mean.
Warranty
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. The length of any warranty we offer in addition to your statutory rights, what it covers, what it excludes, and how a claim works.
Firmware, software and licences
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder, and this one has a settled answer already: the machine ships with Libreboot, the lbmk build system is GPLv3 and Libreboot as a whole is mixed-licence, we make no claim of ownership over it, and the corresponding source offer is on the source page. The finished section will also cover what reflashing the machine does to any warranty we offer, and will state that reflashing is your right either way.
Liability
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. What we are responsible for, the limits on it, and the heads of liability that cannot lawfully be excluded — death or personal injury from negligence, fraud, and your statutory rights as a consumer.
Complaints and disputes
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. How to complain, the timescale we would answer in, and what happens if we cannot agree.
Governing law
TODO-COPYStructure only. The wording below names what belongs here. It is not binding.
Placeholder. Which law applies and whose courts have jurisdiction, drafted so that it does not remove a consumer’s right to sue where they live.
